1. Acceptance
By creating an ARK account or using any ARK service, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use ARK.
2. Eligibility
You must be at least 18 years old to create an account. By signing up, you represent that you meet this requirement.
3. Rider terms
Riders may request accessible transportation through the ARK platform. ARK is a technology platform that connects riders with independent drivers — ARK is not a transportation carrier. Drivers are independent contractors.
Riders must provide accurate pickup and dropoff locations. Cancellation fees apply for cancellations made less than 5 minutes after driver acceptance.
4. Driver terms
Drivers must hold all required licences, certifications, and insurance as specified in the Driver Requirements. Drivers are independent contractors and are not employees of ARK. ARK's platform fee is disclosed in the driver earnings dashboard.
5. Accessibility commitment
ARK charges zero accessibility surcharge. Any failure to enforce this policy should be reported to [email protected].
6. Payments
Fares are calculated using distance, duration, and time of day. Final fares may differ from estimates. Payments are processed by Stripe. Disputes must be raised within 14 days of the trip.
7. Prohibited conduct
You may not: use ARK for any unlawful purpose; discriminate against any rider or driver based on disability, race, gender, religion, or any other protected ground; use automated means to access the platform; or resell access to the platform.
8. Limitation of liability
To the maximum extent permitted by Canadian law, ARK's liability for any claim is limited to the amount paid for the specific ride giving rise to the claim.
9. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
